The Fifth Business may process your personal data in our capacity as data controllers. We are committed to respecting your privacy and protecting your personal data, which is any information that is capable of identifying you as an individual person. This Recruitment Privacy Notice (“Privacy Notice”) describes how we handle and protect your personal data in connection with The Fifth Business’ recruitment processes.
This Privacy Notice only applies to the personal data of job applicants and potential candidates for employment/engagement. It does not apply to our employees, associates/contractors or clients, or other personal data that The Fifth Business collects for other purposes.
As used in this Privacy Notice, “personal data” means information that identifies job applicants and potential candidates, either submitted as part of an online application (e.g. via The Fifth Business Careers Page or online job boards) and/or through alternative channels (e.g. via recruitment agencies, referrals from current employees/associates or speculative applications).
We will process your personal data in accordance with this Privacy Notice, unless such processing conflicts with the requirements of applicable law, in which case, applicable law will prevail.

Personal data we collect
We usually collect personal data directly from you when you apply for a role with us, such as your name, address, contact information, work and educational history, qualifications and achievements. We also may collect personal data about you from third parties, such as professional recruitment agencies, your references, prior employers and employees from The Fifth Business with whom you have interviewed.
Sensitive personal data is a subset of personal data and includes ethnicity, health, trade union membership, philosophical beliefs, sexual orientation, as well as other categories as prescribed by law. We do not seek to obtain and will not collect such data about a candidate unless permitted to do so by applicable laws.

We store your personal data in our Recruitment Tracking System and may retain your data to consider you for future employment opportunities.
We do not make recruitment or hiring decisions based on automated decision-making.
Data recipients and international data transfers
Your personal data may be accessed by our recruitment team and interviewers working in the country where the position for which you are applying is based, or different locations within The Fifth Business global organization. Individuals performing administrative functions and IT personnel within The Fifth Business may also have a limited access to your personal data in order to perform their jobs.
We may share your CV and qualifications with our clients, located globally, as part of our selection process. This is a necessity for the assessment and assignment of new consultants to client projects.
In some countries, you may have fewer rights under local law than you do in your country of residence, but we aim to ensure adequate data protection of your personal data that is processed across The Fifth Business global organization, including the transfer of your personal data to countries other than the one in which you reside.
Data retention
If you accept an offer of employment/engagement from The Fifth Business, any relevant personal data collected during your pre-employment/engagement period will become part of your personnel or associate/contractor records and will be retained in accordance with legal requirements.
If we do not employ/engage you immediately following our interview process, we may nevertheless wish to retain your personal data in our database for the next 24 months to enable us to consider you for suitable roles in the future. We have ongoing and continuous recruitment needs due to the nature of our consultancy business and the requirement to resource client projects, so it is important for us to build a talent pool of potential candidates with different skillsets and levels of experience. We may share your CV and qualifications with our clients, located globally, as part of our selection process. This is a necessity for the assessment and assignment of new consultants to client projects.
If you are unsuccessful at the end of our interview process, we will retain your data for 12 months in case of any requirement to reference notes or decisions made and for the purposes of conducting internal recruitment analysis and process improvement.
Security
We have implemented generally accepted standards of technical and operational security to protect personal data from loss, misuse, alteration, or destruction. Despite these precautions, we cannot guarantee that unauthorized persons will not obtain access to your personal data.
Your rights
We take reasonable steps designed to keep your personal data accurate, complete, and up-to-date for the purposes for which it is collected and used. We also have implemented measures designed to ensure that our processing of your personal data complies with this Privacy Notice and applicable law.
